SnapPack is a service owned and operated by MTS DESIGNS, LLC ("SnapPack," "we," "our," or "us"). By installing, accessing, or using the SnapPack Shopify application and related services (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service.
If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.
SnapPack provides fulfillment photo services for Shopify merchants, including tools to capture, store, manage, and share photos related to order fulfillment. Features may include photo uploads, email delivery to customers, optional SMS/MMS notifications, archives, staff access, branding settings, and subscription-based usage limits.
We may update, modify, or discontinue features of the Service from time to time. We will make reasonable efforts to notify you of material changes that affect your use of the Service.
The SnapPack SMS/MMS Program sends transactional fulfillment-photo notifications on behalf of Shopify merchants using SnapPack. Messages identify SnapPack and the merchant, provide order packing or fulfillment information, and may include a secure link to package photos. The program does not send marketing or promotional content. This feature is optional and controlled by the merchant.
If you enable or use SMS/MMS notifications, you are solely responsible for:
SnapPack acts as a technology provider that facilitates delivery of messages you initiate or configure. We do not obtain consent from your customers on your behalf. You agree not to use SMS/MMS features unless you have all required consents and legal authorizations.
Message frequency varies. Recipients may receive up to one message per fulfilled order when text notifications are enabled. Message and data rates may apply. Reply STOP to unsubscribe from future messages. Reply HELP for help. For additional support, contact the Shopify merchant that sent the order notification or visit https://www.gosnappack.com. Delivery is not guaranteed and may depend on carriers, recipient devices, and third-party messaging providers.
SnapPack and MTS DESIGNS, LLC do not share, sell, or provide mobile phone numbers or messaging consent data to third parties or affiliates for marketing or promotional purposes.
You must have a valid Shopify store and the legal capacity to enter into these terms. You are responsible for maintaining the security of your Shopify store, staff accounts, and any credentials used to access the Service.
You are responsible for all activity that occurs under your store and authorized user accounts, including actions taken by staff or contractors you grant access to.
You agree to use the Service only for lawful purposes related to your business operations. You may not:
Certain features of the Service are available through paid subscription plans. Billing is processed through Shopify's billing system according to the plan you select. Plan limits, pricing, and included features are described in the app and may change over time.
Except where required by law or expressly stated otherwise, subscription fees are non-refundable.
You retain ownership of the photos and other content you upload through the Service ("Your Content"). By using the Service, you grant us a limited license to host, process, transmit, display, and store Your Content solely as needed to operate and provide the Service.
You represent that you have all rights necessary to upload Your Content and to authorize us to process it as described in these terms and our Privacy Policy. You are solely responsible for Your Content and for how it is shared with customers or other recipients, including via email, SMS, or MMS.
The Service, including its software, design, branding, documentation, and related materials, is owned by SnapPack or its licensors and is protected by intellectual property laws. These terms do not grant you any rights to our trademarks, logos, or proprietary technology except as needed to use the Service.
The Service integrates with Shopify and may rely on other third-party providers (such as hosting, email, SMS/MMS messaging, or image storage services). Your use of those platforms remains subject to their own terms and policies. We are not responsible for third-party services outside our reasonable control.
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that Privacy Policy.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or free from security vulnerabilities, or that photos or other data will never be lost. You are responsible for maintaining appropriate backups where needed for your business.
To the fullest extent permitted by law, SnapPack and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising from or related to your use of the Service.
Our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless SnapPack from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your use of the Service, your use of SMS/MMS features (including any failure to obtain or maintain required customer consent), or your violation of these terms or applicable law.
You may stop using the Service at any time by uninstalling the app or canceling your subscription. We may suspend or terminate access to the Service if you violate these terms, misuse the Service, fail to pay applicable fees, or if required by law or platform requirements.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will continue to apply.
We may update these Terms and Conditions from time to time. We will notify you of changes by posting the updated terms on this page and updating the "Last Updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised terms.
These terms are governed by the laws applicable in the jurisdiction where SnapPack operates, without regard to conflict-of-law principles. Any disputes arising from these terms or the Service will be resolved in the courts of that jurisdiction, except where prohibited by law.
